1. Acceptance of Terms
By using our website or purchasing products, you agree to be bound by these Terms and Conditions and all applicable laws of England and Wales.
These terms form a legally binding agreement between you and ORCHARD HOME INTERIORS (Company No. 13146087, registered in England and Wales).
2. Use of Website
You may use our website for legitimate purposes such as browsing, purchasing, and contacting support.
Unauthorised use, including unlawful activity or system interference, is strictly prohibited.
3. User Accounts and Registration
You are responsible for maintaining your account credentials and ensuring all provided information is accurate.
You must notify us immediately of any unauthorised account activity.
4. Products and Pricing
All products are subject to availability. Whilst we endeavour to keep pricing accurate, prices may change without notice.
All prices displayed on our website are inclusive of VAT at the applicable rate (currently 20% standard rate). There are no hidden charges. In compliance with the Digital Markets, Competition and Consumers Act 2024, the total price you will pay, including VAT and any mandatory delivery charges, is shown clearly before checkout.
We do not guarantee that product descriptions are error-free, though we strive for accuracy.
5. Orders and Payment
Orders may be accepted or rejected at our discretion. Payment must be completed before shipment.
We accept payment by Visa, Mastercard, American Express, PayPal, Klarna, Clearpay, and other secure methods. We use PCI-compliant systems to process payments.
6. Shipping and Delivery
We ship to UK mainland addresses via Royal Mail, DPD, Evri, and other reputable carriers. Delivery times typically range from 2–4 business days depending on the service selected and your location.
Surcharges may apply for deliveries to the Scottish Highlands and Islands, Northern Ireland, the Channel Islands, and the Isle of Man.
Risk of loss and damage transfers to you upon delivery.
7. Consumer Rights – Returns and Refunds
Your statutory rights under UK consumer protection law are not affected by these terms. You have two key rights:
1. Cooling-off period (Consumer Contracts Regulations 2013): You have the right to cancel your order within 14 days of receiving the goods, without giving any reason. To exercise this right, you must notify us within the 14-day period, then return the goods within a further 14 days. You are responsible for the direct cost of returning the goods unless the goods are faulty or not as described. We will refund the price you paid (including standard delivery charges) within 14 days of receiving the returned goods or proof of return, whichever is earlier. Refunds will be issued to the same payment method you used for the original purchase.
2. Faulty or misdescribed goods (Consumer Rights Act 2015): Goods must be of satisfactory quality, fit for purpose, and as described. If goods are faulty or not as described, you have a 30-day short-term right to reject them for a full refund. After 30 days, you are entitled to a repair or replacement; if that is not possible or fails, you may claim a price reduction or a final right to reject. We will pay the cost of return postage for faulty or misdescribed goods.
Certain goods are excluded from the 14-day cooling-off right, including personalised items, sealed hygiene products that have been opened, perishable goods, and digital content downloaded after you gave express consent.
8. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
Subject to the above, our liability for breach of contract, negligence, or other cause of action is limited to the purchase price of the product. We are not responsible for indirect or consequential losses.
9. Privacy and Data Protection
Your personal data is handled in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
The supervisory authority for data protection in the UK is the Information Commissioner's Office (ICO), and you have the right to lodge a complaint with the ICO at ico.org.uk.
10. Intellectual Property
All website content, including text, images, logos, and design, is owned by ORCHARD HOME INTERIORS and protected by intellectual property laws.
11. Governing Law and Disputes
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are not satisfied with our service, please contact us first. If we cannot resolve the matter, you may be able to refer your complaint to an alternative dispute resolution provider such as Consumer Dispute Resolution Ltd or the Retail ADR scheme. You can also seek advice from Citizens Advice at citizensadvice.org.uk or 0808 223 1133.
12. Modifications to Terms
We may update these terms at any time. We will notify you of material changes where required by law. Continued use of the website following such changes constitutes acceptance of the revised terms.
13. Severability and Entire Agreement
If any provision of these terms is found to be invalid or unenforceable, the remaining terms remain in full force and effect.
